Building Warrant of Fitness (BWof)

An independent Qualified Persons (IQP) completes inspection and maintenance on specified building systems as part of the BWoF compliance schedule. The Compliance Schedule states the content of specific systems within a building which require ongoing maintenance and annual checks by an Independent Qualified Person (IQP) to ensure those systems specified meet the performance standards for Building Code requirements (NZBC).

A Form 12 or Building Warrant of Fitness (BWoF) is issued to the building owner by the territorial authorities once all certificate's of compliance (Form 12A) have been issued to the council by the building owner (or the owners appointed client). The number of Form 12A's required to be obtained will be dependant on the number of specified systems in the building.

Building owners are required to engage IQP's who undertake the inspection, maintenance and reporting procedures listed on the compliance schedule and issue the Form 12A's.  The IQP works independently for the client or building owner and has no financial interest in the building. 

What are the key factors in determining whether a Form 12A Certificate of Compliance with inspection, maintenance, and reporting procedures can be issued? 

- Verification that each specified system is fully compliant for the previous 12 months.

- Testing meets the performance criteria specified on the compliance schedule.

- Ensuring that the specified systems are kept in good working order, safe for public use.

When would it be appropriate to send in a report to support your 12A certificate? 

Annual reports must be submitted with a 12A certificate as per the Building Act 2004.

What is the IQP responsible for?

- The IQP is responsible for ensuring that a specified system stated in the compliance schedule is performing, and will continue to perform, to the performance standards for that system.
